1. About these terms
These Terms of Service ("Terms") govern your use of the website aetoscosmetics.com, our WhatsApp Business communications, our email outreach, and any commercial engagement with Aetos Pharma Private Limited ("Aetos", "we", "us"), operating under the brand Aetos Cosmetics. By accessing the site, responding to our messages, or initiating a business inquiry, you accept these Terms.
2. Business-to-business engagement only
Aetos Cosmetics is a B2B (business-to-business) white-label cosmetics manufacturer. We engage exclusively with importers, distributors, wholesalers, brand owners and resellers acting in the course of their business. We do not sell directly to consumers and we do not accept retail orders through this website.
If you are not authorized to act on behalf of a business entity that intends to purchase, distribute or import cosmetics, please do not submit an inquiry.
3. What we offer
We provide contract manufacturing and private-label production of cosmetic products including, without limitation: skincare, brightening and serums, body care, hair care, soaps, and personal-care formulations. All products are manufactured at licensed Indian cosmetics certified facilities in India.
Specifications, formulations, lead times, order quantities, certifications, pricing and shipment terms are confirmed in writing on a per-engagement basis through a Proforma Invoice or Sales Contract. Nothing on aetoscosmetics.com, in our marketing emails, or in our WhatsApp communications constitutes a binding offer to sell.
4. Regulatory responsibility
You — the importer, distributor or brand owner — are responsible for:
- Obtaining all import permits, product registrations, sanitary certificates, and regulatory approvals required by the competent cosmetics regulatory authority in your destination country.
- Ensuring product labelling, ingredient declarations, and claims comply with the laws of your destination country.
- Paying all applicable customs duties, taxes and import-related charges in the destination country.
- Securing any consumer-safety, advertising, or marketing approvals required for the resale of the goods in your market.
Aetos provides standard documentation (Certificate of Analysis, Material Safety Data Sheet, Free Sale Certificate, GMP Certificate, ingredient list) to support your regulatory submission, but the regulatory submission itself remains your responsibility.
5. Intellectual property
All website content — text, photography, graphics, product images, layout, branding "Aetos Cosmetics" and "Aetos Pharma", logos and trademarks — is owned by Aetos Pharma Private Limited and protected under applicable Indian and international intellectual-property law. You may not copy, reproduce, distribute, scrape or commercially exploit any part of aetoscosmetics.com without our prior written permission.
When we manufacture under your private label, you retain ownership of your brand marks and packaging artwork you supply. Aetos retains ownership of underlying formulations developed at our cost.
6. Confidentiality
Information exchanged during commercial discussions — including formulations, pricing, specifications, customer lists, technical know-how — is treated as confidential by both parties. We expect the same in return. A formal Mutual Non-Disclosure Agreement may be executed on request prior to sharing detailed pricing or proprietary formulations.
7. Communications and opt-out
If you submit an inquiry, you consent to receive business communication from us — by email, WhatsApp, or phone — relevant to that inquiry and to our commercial relationship. We will not communicate with you for unrelated purposes.
You can opt out of any communication channel at any time:
- Email: click the "Unsubscribe" link in any marketing email, or write to business@aetoscosmetics.co.in.
- WhatsApp: reply STOP, UNSUBSCRIBE or DÉSINSCRIRE to any of our messages.
- Phone: ask us during any call and we will remove your number from our list.
8. No medical or efficacy claims
Cosmetic products are not medicines. Aetos does not make and you must not represent that any Aetos product cures, treats or prevents disease. Any efficacy or benefit claim you make in your destination market is your sole responsibility and must comply with the cosmetic-claims regulations of that market.
9. Liability
To the maximum extent permitted by law, Aetos's total liability arising out of or in connection with any individual order is limited to the invoice value of that order. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, lost reputation or business interruption.
Nothing in these Terms limits liability that cannot be lawfully limited under Indian law.
10. Indemnity
You agree to indemnify and hold harmless Aetos, its directors, employees and affiliates from claims, damages, fines or costs arising out of your breach of these Terms, your unlawful resale of the products, or your failure to comply with the regulatory requirements of the destination country.
11. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the commercial relationship shall be submitted to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India. The parties will attempt to resolve disputes amicably through good-faith discussion before initiating litigation. Where the parties agree in writing, disputes may be referred to arbitration under the Arbitration and Conciliation Act, 1996, seated in Ahmedabad.
12. Changes
We may update these Terms from time to time. The current version is always published at aetoscosmetics.com/terms with the "Last updated" date. Continued use of the site or our services after a change indicates acceptance of the revised Terms.
